Recently there has been a lot of controversy over subliminal messages in the news. Over the last 2-3 years then have gained a lot of media coverage.

First it was McDonalds – they received negative attention for flashing a subliminal advert on the Food Network tv channel. Then it was George Bush in the public eye for, using political subliminal messages to try and manipulate voters during his election campaign.

It is quite sad, but even despite being highlighted in the media like this, both McDonalds and George Bush escaped without any punishment or even formal investigation.

George Bush just refused to comment on the allegations and eventually they went away, and McDonalds claimed it was just a programming error rather than a purposeful subliminal advert. No further investigation ever followed either Bush or McDonalds – sadly.

I think there should be more done to monitor and control the use of subliminal messages and how they are used, but back to the original question:

No subliminal messages are not strictly illegal.

They are not allowed to be used within advertising in the way that you can’t use pure subliminal audio, or flashing subliminal images or text.

But things get a little more complicated when considering a "subliminal suggestion".. A subliminal suggestion is usually a subliminal still image. With just a glance it looks normal, , but after inspecting it closer there is a subliminal suggestion there. Usually this is a link to sex, . Typical examples of this can include somehow hiding the word "sex" within the imagery / background of the advert, or even just having a beautiful girl holding / using the product – Pepsi often use this female imagery for example, even down to the very fact that their bottles are shaped to model the body of a beautiful woman.
